Muxlim is a family-friendly site dedicated to bringing you online services that enhance the Muslim lifestyle. The Muslim lifestyle is more than just the religion, which is the core set of values for the community on this site.

Muxlim is focused on the Muslim lifestyle as part of a diverse, all-inclusive world which recognizes and welcomes people of all faiths and backgrounds who want to share, learn and have fun.

Terms of Service

1. Acknowledgement and Acceptance

By using, visiting and/or by registering to be a user of the muxlim.com its subdomains and related web sites or services, e.g. spaces.muxlim.com, forums.muxlim.com, blogs.muxlim.com, images.muxlim.com, search.muxlim.com, islamictorrents.net, quran.muxlim.com, tv.muxlim.com, as well as other web sites or services provided by Muxlim referring to these Terms of Service (collectively the "Service" or "Site", as applicable), you hereby confirm that you have read and understood and agree to these Terms of Service ("TOS").

The Service is offered to you by Muxlim Inc. and its affiliates (collectively "Muxlim" or "we/us" respectively). The use of the services made available by Muxlim is conditioned on your acceptance (without modification) of these TOS and any other terms and notices, for example campaign or product/service specific terms which may be incorporated by reference or are presented otherwise on the Site or in connection with the Service. Your use of the Site and Service constitutes your agreement to all such terms, conditions, and notices.

If you do not agree to these TOS, you must immediately discontinue your use of the Site and Service.

2. Use of the Service

Eligibility

No person under the age of 16 or who is a minor under his/her local legislation is eligible to use and/or register as a user of the Service and/or use of Services which are provided subject to fee(s). In such event you will need to obtain consent from your parent(s) or other legal guardian(s) for using Services subject to fee(s) and/or registering as a user of the Service.

If you are not 16 years of age or older, have your parent(s)/legal guardian(s) review these TOS and help you register. By registering and/or purchasing Services you represent that your parent(s)/legal guardian(s) have agreed to these TOS. Parent(s)/legal guardian(s) are advised to exercise supervision over their children's on-line activities.

Technical Requirements

The Service provided herein is network dependent and may require network support. In order to be able to use the Service you need to have access to the Internet through the Internet service provider (ISP) of your choice and you need to ensure that your mobile network operator/carrier supports data traffic delivery. Some networks have also other limitations that may affect your ability to use the Service. You are responsible for obtaining any information necessary regarding your abilities to use the Service from your respective service providers.

Use of some parts of the Service may be subject to a separate charge, which is then announced separately within the Site in connection with that part of the Service. You may incur additional fees from the use of mobile and/or Internet services of your network or other telecommunications operator/carrier and/or other service provider, including without limitation SMS, MMS and mobile Internet browsing and other services that require the use of airtime and mobile data services. Muxlim assumes no responsibility for the payment of such fees. Your operator/carrier is in every respect solely responsible for the services it provides to you.

Use of some parts of the Service may require installation of software made available by Muxlim or third parties. Such software is subject to separate license terms.

Terms of Use

Your use of the Site and Service, including without limitation submission or posting of information, data or materials whether on profiles, pages, message boards, chat rooms, email or in any other form or manner, is permitted only for your non-commercial purposes, and shall comply with these TOS and any other applicable terms and notices, as well as with any applicable laws. Any commercial use of the Site or Services shall be always separately agreed with Muxlim. Commercial use may be permitted by Muxlim. Please contact Muxlim concerning any commercial use.

Content Submission

Certain elements of the Service enables you to submit, process, distribute and make available information and content. By submitting, and upon such submission of, any information or materials, e.g. text , pictures, feed-back, data, software, music, sound, images, icons, photographs, graphics, videos, messages, answers, questions, comments, suggestions, scores, hints, strategies, concepts, designs, ideas, plans, orders, requests or the like, or any other or any other material that can be transmitted through Services ("Content") to Muxlim or through the Site and Service, for example, in chat rooms, by e-mail, by uploading, linking, SMS, and/or MMS, you understand and agree that you are solely and fully responsible for any and all aspects of the Content submitted, including but not limited to its legality, appropriateness and non-infringement of third party intellectual property rights, and we shall not be liable in any way for such Content. You agree to follow all applicable laws and regulations applicable to your use of the Site and Service. Such laws and regulations include, without limitation, those governing copyright, defamation, privacy, publicity and the access or use of others' computer or communication systems.

The role of Muxlim with respect to the Content is that of a hosting service provider under the Act on Provision of Information Society Services of Finland (458/2002) and respectively of Directive 2000/31/EC of the European Parliament and of the Council on Electronic Commerce.

We ask that you use good judgment and exercise discretion in choosing appropriate subjects and subject matter for any Content submissions to the Site and Service. Remember that privacy laws may protect individuals with respect to their being mentioned, photographed or videotaped, so please respect the privacy of others by asking for and obtaining their consent to be mentioned, photographed or videotaped, as well as for your submissions of Content to the Site and Service.

You expressly agree that you will not post, publish, transmit, distribute, or upload through the Site or Service any unauthorized or unsolicited bulk e-mail solicitations, chain letters, advertisements, marketing or promotional materials (unless Muxlim has consented to such use), "junk mail", "spam", pyramid schemes or any other solicitations or communications, including without limitation spamming us or other users of the Site and Service, or use or collect other users e-mail addresses or phone numbers, or other users information or postings, or use the Site or Service to perform any data collection, extraction or mining or gain or attempt to gain unauthorized access to our or any Site visitor's computer system.

You furthermore agree that your Content will not contain any material and you will not send any such messages to any other user or us that is unlawful, libelous, slanderous, defamatory or invasive of another person's right of privacy or right of publicity, or that we may reasonably deem harmful, vulgar, obscene, derogatory, pornographic, abusive, harassing, threatening, hateful, objectionable with respect to race, religion, creed, national origin or gender, or otherwise unfit for publication. Posting, sending, uploading or other use of such Content at the Site or Service shall be deemed to constitute a substantial breach of the ToS.

We shall have no obligation to monitor any of the Content provided by you to us and/or to the Site and Service, but may do so at our discretion. We are not able to guarantee full monitoring of the material posted and published on profiles, pages, message boards and/or chat rooms by the users.

Your use of public forums like profiles, pages, message boards and chat rooms is at your own risk and you are responsible for all and any actions you take on the profiles, pages, message boards and/or chat rooms as well as for all and any actions that you take based on information gained on profiles, pages, message boards and/or chat rooms. Further, please note that while there are always risks associated with providing personal or other data, whether in person, by phone or over the Internet, and no system of technology is completely safe, "tamper" or "hacker-proof" do not under any circumstances use your full real name or give out your detailed address, phone number or any other personally identifiable information about yourself or anybody else on a profile, page, message board, chat room and/or any other similar medium.

Muxlim reserves the right, at its sole discretion, to limit or prevent Content submission or use of the Service and/or delete any Content from the Service without prior notice. Muxlim may impose instructions, limitations or other guidance concerning Content submission and use of Services at any time.

Deleting of the Content

Without limiting the generality of the foregoing, you expressly acknowledge that Muxlim has the right, at its sole discretion, to delete any Content from the Service, including email messages stored in the Service, without prior notice.

3. Content Available at the Service

The Service will include Content submitted by users of the Service. Muxlim is not affiliated with the Content in any way and shall not be regarded as a publisher of the Content. The role of Muxlim with respect to Content submitted by users is that of a hosting service provider under the Act on Provision of Information Society Services of Finland (458/2002) and respectively of Directive 2000/31/EC of the European Parliament and of the Council on Electronic Commerce. You should observe that the Content submitted by other users may include functional elements such as Apps.

You acknowledge that the Apps are made available by users and other third parties, and not by Muxlim. You shall use the Apps at your own risk, and Muxlim assumes no responsibility for the Apps. Apps may include separate license terms of the third party making the App available. You acknowledge that when you use Apps, Muxlim may disclose to the provider of the Apps your Personal Data.

Muxlim applies to the notice and take-down procedure pursuant to the Act on Provision of Information Society Services of Finland. Please refer to the guidelines of the notice and take-down procedure for information on submitting notice and take-down requests.

4. Editorial Content

The Service may include content made available by Muxlim and its partners, such as news and other content edited and made available by Muxlim and its partners ("Editorial Content"). All intellectual property rights and other proprietary rights to Editorial Content are retained by Muxlim or its partners or its content suppliers. No license to such Content is granted to You.

5. License to Submitted Content

By submitting, and upon such submission of any Content to us or through the Site and Service, for example, in chat rooms, by e-mail, by uploading, linking, SMS, and/or MMS, you will grant Muxlim worldwide, irrevocable, perpetual, non-exclusive, royalty-free and assignable license to use, reproduce and have reproduced, modify and have modified, publicly perform and publicly display such Content and distribute reproduced and modified copies thereof for the purposes of the provision of the Service.

6. Indemnity

YOU AGREE TO INDEMNIFY AND HOLD US, OUR AFFILIATES, SUBSIDIARIES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS AND LICENSORS HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING WITHOUT LIMITATION REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF CONTENT YOU SUBMIT, POST, LINK, TRANSMIT OR OTHERWISE MAKE AVAILABLE ON OR THROUGH THE SITE AND SERVICE OR YOUR USE OF THE SITE AND SERVICE.

7. Managing your Registration and Communication Preferences

If you have given your consent to us that we may send you marketing material, you have the right, at any time, to prohibit us from using any personal information collected from you for direct marketing purposes.

We may send you information on potential special offers or other relevant marketing material related to Services even without your prior consent when not using electronic platforms in which case you have the right, at any time, prohibit us from doing so.

You may also, at any time, terminate your registration to the Service. Please note that if you choose to terminate your registration, you will no longer have access to the Service and all information stored in your account will be permanently deleted.

To use your rights relating direct marketing or to terminate your registration or to amend, review or remove your personal information, please send a request through our contact page.

8. Proprietary Rights

The Services and Site created by Muxlim as well as the Editorial Content are Copyright � Muxlim (or the respective Muxlim's suppliers or other third parties).

Any rights not expressly granted herein are reserved. Reproduction, transfer, distribution or storage of part or all of the contents in any form without the prior written permission of us is prohibited, except in accordance with the following terms.

The Site may be used solely for private, non-commercial purposes, subject to these TOS and any applicable laws.

Please note that individual documents and/or services provided on the Site may be subject to additional terms indicated in connection with the documents and/or services.

9. Payable Services

General

Some Services are provided against a payment by you ("Payable Services"). To use the Payable Services you need a sufficient balance of credit, which is credit purchased by you from Muxlim and allocated to your user account ("Muxlim Credit"). The Muxlim Credit may be called Dinars or other brand names. Muxlim Credit may be utilised at the Service only, and the Muxlim Credit cannot be utilised with third party services. You are not allowed to resell Payable Services.

You must deposit sufficient Muxlim Credit in your user account using payment options available from time to time (for example credit card payment or PayPal payment may be available from time to time). Muxlim Credit cannot be transferred to another user account. You are however entitled to purchase Muxlim Credit as gift for other users of the Service.

Muxlim does not guarantee that you will be able to use your Muxlim Credit balance to purchase all the Payable Services. Certain Payable Services may have to be paid separately.

A credit balance for Muxlim Credit in your user account expires 365 days after the last chargeable use of that Muxlim Credit. Credit balances that are not used within this period will be lost.

Refund Policy

You can request a refund for unused Muxlim Credit within 30 days of the purchase, by submitting a request through our contact page. Refund requests carried out through other means shall not be eligible for a refund.

Upon a duly submitted refund request, Muxlim will refund you the credit balance of your Muxlim Credit. Upon a duly submitted refund request, Muxlim will refund you on a pro rata basis for the unused period of a Product. The banking fees and other out of the pocket transaction costs will be deducted from the refund.

All refunds shall be paid to the person who initially purchased the Muxlim Credit or Product, either through the original payment method used, or any other reasonable payment method to be determined by Muxlim in its sole discretion.

Muxlim reserves the right to terminate these Terms of Service with immediate effect in the event of any abuse by you of these terms relating to refunds.

Charges and Rates

You shall pay Muxlim any applicable charges and rates as stated on the Service.

Muxlim may change the charges payable for the purchase of Payable Services at any time without any notice to you. You can choose whether or not to accept the new charges prior to completing your next purchase of the applicable Payable Service. The new charge will apply to your next purchase after the adjustments have been published on the Service. You agree that by continuing to use the Payable Services following the adjustments of the charges, you accept the new charges.

Tax

In respect of payable services Value Added Tax generally applies if you are located in the EU. Sales taxes and other local taxes may apply in certain countries.

10. Limitation of Liability

The Site and Services are provided "as is" and "as available". No warranty, either express or implied, is made in relation to the accuracy, reliability or contents of the Site or Services.

MUXLIM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, DIRECT OR INDIRECT, INCLUDING, BUT NOT LIMITED TO, ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT EXCEPT WHERE SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.

TO THE FULL EXTENT PERMISSIBLE BY LAW, IN NO EVENT WILL MUXLIM BE LIABLE TO ANY USER OF THE SITE (INCLUDING REGISTERED USERS) OR ANY OTHER THIRD PARTY IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY FOR LOST REVENUES, LOST PROFITS, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, ARISING OUT OF THE SUBJECT MATTER OF THESE TOS, EVEN IF MUXLIM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MUXLIM'S AGGREGATE LIABILITY UNDER THIS AGREEMENT WITH RESPECT TO ANY DAMAGES ARISING UNDER ANY CLAIMS OR AGGREGATE OF CLAIMS SHALL BE ALWAYS LIIMITED TO THE AGGREGATE AMOUNT OF PAYMENTS ACTUALLY PAID BY THE REGISTERED USERTO MUXLIM HEREUNDER DURING THE SIX (6) MONTHS PRECEDING SUCH CLAIM.

11. Your Account, Password and Security

Upon registration as a user of the Service you will be assigned a user account with your personal user name and password. Your registration as a user of the Service is personal and cannot be transferred. Only one registration is allowed per person. If more than one account was found by the same person, Muxlim reserves the right to terminate any or all of them.

You acknowledge and agree that the Service will be available and is provided to you based on the information provided by you upon registration as a user of the Service. You are responsible for keeping your registration information up to date, including, but not limited to, contact information, in order to enable proper and accurate Service.

Actions taken using your valid user name and/or password, are assumed by us to be taken by you and thus you are personally responsible for such actions. Muxlim Credit under your user account are usable with your user name and password, and therefore you shall be solely responsible for any use of Muxlim Credit using your user name or password.

If your user name and/or password is compromised, or if you become aware of any un-authorized use of your account or other breach of security, you are responsible for promptly notifying Muxlim. You can notify us through our contact page or accessing the password retrieval page on www.muxlim.com. You can also change the password yourself by accessing your personal data on www.muxlim.com. You may not use anyone else's account at any time or permit anyone else to use your account (subject to the exception of parental guidance set forth in Section 2 "Eligibility").

12. Breach of these TOS

In the event we deem, at our sole discretion, that you are in whatsoever manner in breach of these TOS or any other applicable terms and notices, we shall take any action of whatsoever nature, as we may deem at our exclusive discretion appropriate, to address your breach, including without limitation removal of Content, termination of registration, prevention of access and any legal action in any competent authority or court. Specifically, we have the right to terminate your right to use the Site and Service without notice at any time for any reason at our sole discretion and in particular, if you breach these TOS or use the Site and/or Service illegally or in a way that we deem inappropriate or in the event you have not been using the Site and/or Service for a period of six (6) consecutive months.

13. Links

You are entitled to include a promotional link from your website to the Service web site. The link shall be clearly visible.

Although the Site and Service provides and allows you to provide links to web sites on the World Wide Web owned and operated by third parties we have no control over the content of such third party sites and cannot assume any responsibility or liability for material created or published by such third-party sites. A link to a third-party site does not imply that we endorse the site or the products and services provided on such third-party site.

Upon following a link to a third-party site please review the applicable terms and conditions for that site before using the site.

14. Other Terms and Conditions

Availability of the Service and Modification of the Terms of Service

The Site and Service are available solely as decided by us and may be subject to maintenance breaks and any other kinds of actions. We may remove any information, including but not limited to personal data or data, material or content provided by any of the users, any other data or material or terminate the Site and/or Service or any part thereof at any time at our sole discretion.

We may from time to time amend these TOS or change, modify or withdraw access to this Site or its content at any time with or without notice. We recommend that you re-visit these TOS from time to time to learn of any such changes.

Non-Waiver and Severability

The invalidity of a provision of these TOS or any other applicable terms and notices shall not affect the validity of the remaining provisions. The invalid provision shall be replaced with a valid provision which comes closest to the result and purpose of these TOS or any other applicable terms and notices. These TOS shall neither exclude nor limit any of your mandatory rights in your country of residence.

Surviving Clauses

Clauses 3 (License to Submitted Content), 4 (Indemnity), 6 (Proprietary Rights), 7 (Limitation of Liability) and 11 (Other Terms and Conditions) shall survive the termination or expiry of this TOS.

Governing Law and Jurisdiction

These TOS and the relationship between the user and Muxlim shall be governed by and interpreted in accordance with the laws of Finland excluding its rules for choice of law.

All disputes that cannot be solved amicably shall be settled by the district court of Helsinki, Finland.
